September 9, 2010   TABLE OF CONTENTS   3.7 Exclusions   Weekly disability income benefits are not payable for disabilities resulting directly or indirectly from Injury resulting from or occurring during the commission by the Covered Person of an illegal act (1) involving violence or the threat of violence to another person, or (2) in which the Covered Person illegally uses a firearm, explosive or other weapon likely to cause physical harm or death, or (3) involving reckless driving or driving under the influence of alcohol or illegal drugs (driving while intoxicated). In addition, weekly disability income benefits are not payable for disabilities resulting directly from an Injury or Illness resulting from the commission by the Covered Person of any other Serious Illegal Act. For purposes of this exclusion, the term "Serious Illegal Act" shall mean any act or series of acts that, if prosecuted as a criminal offense, a sentence to a term of imprisonment in excess of one year could be imposed. For the purposes of this exclusion, the lack of a conviction or issuance of a citation by a law enforcement body is not conclusive as to whether or not the charges for services resulted from or during the commission of an illegal act.
